These Terms of Service (“Terms”) are a legal agreement between you and Capitana (“Capitana,” “we,” “us,” or “our”) governing your use of the Capitana mobile application (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. By using the App, you represent that you meet this requirement.
2. Your account
You sign in using Sign in with Apple. You are responsible for maintaining the security of your device and account and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
You may delete your account at any time from within the App. See our Privacy Policy for how we handle your data on deletion.
3. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
- Upload or transmit content that is unlawful, harmful, harassing, or infringes the rights of others;
- Misuse the messaging or crew features to harass, spam, or harm other users.
We may suspend or terminate your access if you violate these Terms.
4. Safety notice and disclaimer — please read
Capitana is a convenience and information aid. It is not a substitute for proper seamanship, official navigation equipment, or professional judgment. Your safety at sea is your own responsibility.
- Navigation and charts. Any charts, maps, radar, or marine data in the App are for general reference only. They may be incomplete, delayed, or inaccurate. Do not rely on the App for navigation. Always use official, up-to-date nautical charts and approved navigation equipment.
- Weather. Weather and marine-condition information is provided by third parties and may be inaccurate or out of date. Always consult official sources before making decisions that affect your safety.
- Anchor Alarm. The Anchor Alarm is an aid that uses your phone’s GPS to estimate drift. Its accuracy depends on GPS signal quality, your device, its battery and settings, operating-system behavior, and permissions you grant. It may fail to alert, alert late, or produce false alerts. Do not rely on it as your sole means of detecting a dragging anchor. Maintain a proper anchor watch.
- Emergency features. Any emergency contacts or information in the App are for convenience only and are not a substitute for official emergency services. In an emergency, contact the appropriate authorities directly (for example, the Coast Guard, or your local emergency number).
You assume all risks associated with boating and with your use of the App.
5. Third-party services and content
The App relies on third-party services (including Apple, Supabase, and Google) and may display third-party content or link to third-party services. We do not control and are not responsible for third-party services or content, and your use of them may be subject to their own terms and privacy policies.
6. Paid features
The App may offer or preview paid features or services in the future. Any such features, and the terms and pricing that apply to them, will be presented to you before you purchase. Purchases made through the App are processed by Apple and subject to Apple’s terms.
7. Intellectual property
The App and its content (excluding your own content and third-party content) are owned by Capitana or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
8. Disclaimer of warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any information it provides is accurate or reliable.
9. Limitation of liability
To the maximum extent permitted by law, Capitana and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, property, or personal injury, arising out of or related to your use of (or inability to use) the App — including any reliance on its navigation, weather, anchor-alarm, or emergency features. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Capitana from any claims, damages, or expenses arising out of your use of the App or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time.
12. Governing law
These Terms are governed by the laws of the state of Delaware, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above. Your continued use of the App after changes take effect means you accept the updated Terms.
